These Terms & Conditions (“Terms”) govern your access to and use of the website www.klinikbustari.com (the “Website”) and the services provided by Bustari Healthcare Sdn Bhd, trading as Klinik Bustari (“we”, “us”, “our”, the “Clinic”).

By accessing the Website, making an online booking, or attending our Clinic, you confirm that you have read, understood, and agreed to be bound by these Terms together with our Privacy Policy. If you do not agree, please do not use the Website or our services.

1. Introduction & Acceptance

These Terms form a legally binding agreement between you (“you”, “your”, “Patient”) and Bustari Healthcare Sdn Bhd. By using the Website, submitting our online appointment form, paying a deposit, attending the Clinic, or otherwise engaging our services, you agree to be bound by these Terms in full.

If you are booking on behalf of another person (e.g. your child, dependent, or someone you legally represent), you confirm that you have authority to do so and accept these Terms on their behalf.

2. Definitions

  • “Clinic” means Klinik Bustari, located at GF, Lot 4081, Sukma Commercial Centre, Jalan Sultan Tengah, 93050 Kuching, Sarawak, operated by Bustari Healthcare Sdn Bhd.
  • “Website” means www.klinikbustari.com and all subdomains, pages and online tools we provide.
  • “Service” or “Services” means any medical consultation, procedure, screening, vaccination, or other healthcare service offered by the Clinic.
  • “Booking” means a request for an appointment submitted through the Website, WhatsApp, telephone, email, or in person.
  • “Deposit” means a payment of RM50 required to secure a Circumcision Service booking.
  • “Patient” means the individual receiving the Service, whether self-booked or booked by a parent/guardian.

3. Eligibility

To use the Website and book an appointment, you must:

  • Be at least 18 years of age, or have the consent and supervision of a parent or legal guardian (who must complete the booking on your behalf).
  • Provide accurate, current and complete information.
  • Have the legal capacity to enter into a binding contract under Malaysian law.

For paediatric and circumcision (khatan) bookings, the parent or legal guardian’s contact details are mandatory.

4. The Website

The Website is provided for general informational purposes and to enable patients to book appointments. We reserve the right to modify, suspend or discontinue any part of the Website at any time without notice. We do not warrant that the Website will be available continuously or free from errors, viruses or other harmful components.

5. Medical Disclaimer

Not a substitute for medical care. Information on the Website — including blog articles, service descriptions, and FAQs — is general health information only. It is not medical advice and does not establish a doctor–patient relationship. A doctor–patient relationship is formed only upon attending the Clinic for consultation.

In a medical emergency, do not rely on the Website or online booking. Call 999 (Malaysia emergency line) or go to the nearest hospital emergency department immediately.

While we strive to keep medical content accurate and up to date, we make no representation that all content is current or applicable to your specific condition. Always consult a qualified medical professional before making decisions about your health.

6. Online Appointment Booking

The Website allows you to request an appointment by submitting a booking form. By submitting a Booking:

  • You confirm that all information provided (name, contact, MyKad/ID, service requested, date/time selected) is accurate.
  • You consent to receive appointment-related communications via WhatsApp, SMS, telephone or email.
  • You acknowledge that submission of a Booking is a request, not a guaranteed confirmation. The slot is reserved tentatively pending our confirmation.

We will contact you to confirm the Booking, typically within 2 working hours. If the chosen slot is no longer available (e.g. simultaneous booking), we will offer an alternative time.

For verification, we may send a One-Time Password (OTP) to your WhatsApp before processing the Booking.

7. Deposits (Circumcision Service Only)

A RM50 non-refundable deposit is required for all Circumcision Service bookings. The deposit:

  • Is processed via our authorised payment gateway, ToyyibPay (Bumiwangsa Maju Sdn Bhd).
  • Secures your time slot — the appointment is not confirmed until the deposit is received.
  • Will be deducted from the total procedure fee on the day of the procedure.
  • Is non-refundable in cash, except as required by Malaysian law.

Deposits are not currently required for non-circumcision services. We reserve the right to introduce deposits for other procedural services in future, with prior notice.

8. Cancellation, Rescheduling & No-Show

8.1 Circumcision Bookings (with Deposit)

8.2 Cancellation by the Clinic

If we cancel your appointment due to unforeseen circumstances (e.g. doctor unavailability, medical emergency, public holiday), we will:

  • Notify you as early as possible via WhatsApp / call.
  • Offer to reschedule at no charge.
  • Refund the deposit in full if a mutually acceptable rescheduled date cannot be agreed.

8.3 Non-Deposit Appointments (General Services)

For non-circumcision appointments (general consultation, vaccination, screening, etc.), no deposit is required. However, we kindly request that you:

  • Provide as much notice as possible if you need to cancel or reschedule.
  • Inform us by WhatsApp (016-4534234) or telephone if you cannot attend.

Repeated no-shows may affect future booking privileges.

9. Walk-In Patients

Walk-in patients are welcome subject to availability and the queue at the time of arrival. Patients with confirmed appointments will be given priority for their scheduled time slot. For certain procedural services (circumcision, minor surgery), a prior appointment is strongly recommended.

10. Fees & Pricing

Service fees displayed on the Website are indicative and provided for general guidance. The final fee for any consultation, procedure, medication or service will be determined after assessment by our doctor and may vary based on:

  • Clinical complexity and time required
  • Materials, consumables or medication dispensed
  • Additional tests, investigations or procedures performed
  • Panel or insurance arrangements

An itemised receipt will be provided for every transaction. Fees are quoted in Malaysian Ringgit (MYR) and are subject to change without prior notice.

11. Payment Methods

We accept the following payment methods:

  • Cash
  • Credit and debit cards (Visa, Mastercard)
  • Online bank transfer / DuitNow
  • QR code payment (DuitNow QR, e-wallets)
  • ToyyibPay (for online deposits)
  • Panel / insurance billing (for eligible patients with prior arrangement)

Payment is due at the time of service unless otherwise agreed in writing.

12. Patient Responsibilities

As a Patient, you agree to:

  • Provide truthful, accurate and complete medical history, allergies, and current medications.
  • Disclose any pre-existing conditions relevant to the consultation or procedure.
  • Attend appointments punctually. If you arrive significantly late, we may need to reschedule.
  • Follow all clinical advice and aftercare instructions.
  • Settle outstanding fees at the time of service.
  • Inform us promptly of any adverse reactions or complications.

Failure to disclose material medical information may compromise treatment outcomes and limit our liability (see Section 17).

13. Conduct & Behaviour

We are committed to providing a safe, respectful environment for our patients and staff. You agree to behave respectfully toward Clinic staff, doctors, and other patients. We reserve the right to refuse service to, and remove from our premises, any person who:

  • Behaves abusively, threateningly or aggressively
  • Is under the influence of alcohol or illicit substances
  • Engages in fraudulent activity or attempts to deceive Clinic staff
  • Refuses to comply with reasonable clinical or safety instructions

Persistent breach of this section may result in permanent refusal of service.

14. Privacy

Your personal data is collected, used and protected in accordance with our Privacy Policy & Personal Data Protection Notice, issued under the Personal Data Protection Act 2010. By accepting these Terms, you also acknowledge the Privacy Policy.

15. Intellectual Property

All content on the Website — including text, graphics, logos, photographs, blog articles, service descriptions, page layouts, software, and brand elements — is the property of Bustari Healthcare Sdn Bhd or its licensors and is protected by Malaysian and international copyright, trademark and other intellectual property laws.

You may view and print pages for personal, non-commercial use. You may not:

  • Reproduce, republish, distribute or modify any Website content without our prior written consent.
  • Use our name, logo or brand elements for commercial purposes.
  • Reverse engineer, scrape, or use automated tools to extract data from the Website.

16. Third-Party Services

The Website integrates with third-party services to deliver our online functions. These include:

  • ToyyibPay (Bumiwangsa Maju Sdn Bhd) — payment gateway
  • Resend — transactional email delivery
  • WasenderAPI — WhatsApp messaging
  • Google Firebase — secure database and authentication
  • Meta Platforms — advertising and analytics (Meta Pixel)

Use of these services is governed by each provider’s own terms and privacy policy. We are not responsible for outages, errors, or breaches caused by third-party providers, but we will use reasonable efforts to mitigate any impact on our patients.

17. Limitation of Liability

Please read this section carefully. It limits our financial exposure to you.

To the maximum extent permitted by Malaysian law:

  • Our total liability to you arising out of or in connection with the use of the Website or the provision of any Service shall not exceed the total fees actually paid by you to the Clinic in the twelve (12) months preceding the event giving rise to the claim.
  • We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of income, loss of business opportunity, loss of data, or emotional distress, even if we have been advised of the possibility of such damages.
  • We are not liable for any outcome of treatment that arises from inaccurate, incomplete or undisclosed medical information provided by the Patient.
  • We are not liable for the acts, omissions or default of third-party providers, panels, insurers or referral specialists.

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our proven negligence;
  • Fraud or fraudulent misrepresentation;
  • Any liability that cannot be excluded under Malaysian law (including the Consumer Protection Act 1999 and the Medical Act 1971).

18. Indemnification

You agree to indemnify and hold harmless Bustari Healthcare Sdn Bhd, its directors, doctors, employees and agents from and against any claims, losses, damages, liabilities, costs or expenses (including reasonable legal fees) arising out of or relating to:

  • Your breach of these Terms;
  • Your misuse of the Website;
  • Your provision of false, misleading, or incomplete information;
  • Any violation by you of applicable law or third-party rights.

19. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any dispute, controversy, or claim arising out of or in connection with these Terms, or the breach, termination or invalidity thereof, shall be subject to the exclusive jurisdiction of the courts of Sarawak (sitting in Kuching).

Before commencing court proceedings, the parties shall make reasonable efforts to resolve the dispute amicably through good-faith discussion.

20. Severability, Waiver & Changes

20.1 Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable; the remaining provisions shall continue in full force and effect.

20.2 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. No waiver is effective unless given in writing by an authorised representative.

20.3 Changes to These Terms

We may amend these Terms from time to time to reflect changes in law, our services, or our practices. The current version is always available at www.klinikbustari.com/terms-and-conditions.html. The “Last updated” date at the top of these Terms indicates when they were most recently revised. Your continued use of the Website or our services after changes are posted constitutes acceptance of the revised Terms.
